Acceptance of These Terms
These Terms of Service ("Terms") are a legal agreement between you and Valgorithmic, Inc. ("Valgo," "we," "us," or "our"). They govern your use of our websites and services, including valgo.ai and the Human Crash Baselines tool at humanbaselines.com (together, the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
The Service
valgo.ai is Valgo's company website. Human Crash Baselines is an interactive tool for computing human crash rates across city-level geofenced areas and trucking corridors, published as a methodologically transparent reference for assessing the relative safety of automated driving systems against human-driven baselines. The Services are provided for informational and research purposes.
Eligibility & Access
Access to the Human Crash Baselines tool is currently invite-only and limited to email addresses we have approved. You are responsible for any activity that occurs under your access. You must be able to form a binding contract to use the Services, and you may not use them if barred from doing so under applicable law.
Acceptable Use
You agree not to:
- scrape, bulk-download, or systematically extract data or outputs from the Services;
- circumvent, disable, or reverse-engineer access controls, rate limits, or security measures;
- use the Services to identify, contact, or solicit any person involved in a crash;
- misrepresent the outputs, or use them to establish fault or liability in any individual crash;
- interfere with or disrupt the integrity or performance of the Services; or
- use the Services in violation of any applicable law or these Terms.
Intellectual Property & Open Source
The Human Crash Baselines tool's source code is released under the Apache License 2.0; you are free to use, modify, and distribute it with attribution under that license. Except for content made available under an open-source or third-party license, the Services and their content, including text, design, and the Valgo name and logo, are owned by Valgorithmic, Inc. and protected by intellectual-property laws.
Third-Party Data & Attributions
The baselines are derived from public crash and roadway-exposure data, including sources such as NHTSA FARS/CRSS, TxDOT CRIS, California CHP SWITRS/CCRS, ADOT, Nevada DOT, FHWA HPMS, Caltrans, and NOAA, with map data and imagery from OpenStreetMap, CARTO, and Esri. These sources are subject to their own terms and licenses; see the in-tool "Data Sources & Attributions" for details. We publish only derived statistics (counts, rates, and bounds) and link to the underlying sources rather than redistributing them in bulk.

THE SERVICES AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
The baselines are aggregate statistics derived from public crash and roadway-exposure data, published as a transparent reference. All figures are de-identified and contain no personally identifying information.
They are not litigation evidence. Crash data compiled for safety analysis is shielded from discovery and admissibility under 23 U.S.C. § 409 in many states, and nothing in the Services is offered to establish fault or liability in any individual crash. The underlying records must not be used to identify, contact, or solicit anyone involved in a crash; state anti-solicitation laws prohibit this.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VALGO AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
Indemnification
You agree to indemnify and hold harmless Valgorithmic, Inc. and its officers, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services or your violation of these Terms.
Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising out of or relating to these Terms or the Services.
Changes to These Terms
We may update these Terms from time to time. Updates take effect when posted, and we will revise the "Last updated" date above. Your continued use of the Services after an update means you accept the revised Terms.
